The silence from those of us not affected by the green card process who are legal immigrants is annoyingly deafening. The entire economy has picked up now and yet legislation takes forever to pass!
What does it take for lawmakers to turn their heads? People holding placcards and signs on streets protesting? Is that the only way to have something heard? Obviously, written articles such as these isn't helping!

U probably are asking the wrong community...most of the people here are retrogressed...and cannot file i485...so we wudnt know...Ask your question at Immigrationportal.com or immigration.com

You have to understand one thing...your AP/EAD are tied to your I-485 application ..which in turn is tied to your H1....If you quit now, you will risk abandoning of your GC...which means you loose AP/EAD....
What I would do in your case is this....You said you filed on July 2..wait for 180 days....invoke AC21....tell your new employer that you want to spend 6 months in Inida...and the come back to US ....this way u don't loose your EAD/AP and also are able to stay in India....OFCOURSE all this is possible if your I-140 is approved....

I was working for Company A from 2000 to 2004. Company A applied for my GC in 2002. However, the company was not doing well until I left it. It was not paying me the salary which came out in PW. Company A continued with my GC processing and I filed for I140 and 485 last year in June. Now received the following RFE for I140:
Please submit documentary evidence that you, the petitioning employer, have the financial
ability to pay the wage/salary you offered the beneficiary. This evidence must show that you
have this financial capability on the date you fied the ETA with the Department of Labor and
cover up until the visa is issued. The petitioner may submit evidence that their net income is
equal to or greater than the proffered wage, evidence that the petitioner's net current assets
are equal to or greater than the proffered wage, or evidence that the petitioner not only is
employing the beneficiary but also has paid or is currently paying the proffered wage. The
service wil also consider copies of audited annual reports of the employer, or copies of
audited financial statements of the employer. Evidence is needed for 2002-2003.
Does anyone have some idea how to get the audited financial statements or audited annual reports?. I know that the company never had any audited reports. I had submitted the bank statements of the company and the tax returns with my I140. However, it seems that they want the audited reports. The company was not doing well in 2002/2003. Yes. She can get H4 visa stamp based on your H1 extension approval notice.

RFE is very clear, basically they are asking the documents, which has Picture ID, where your name was mentioned as Pravin, PRaveenkumar and Pravinkumar.
I dont think u will be able to produce the picture Id for the birth certificate, but for the passport or any other state issued ID, you might be able to have some kind of picture Id dcument which bears your photo.
Please consult a good attorney who can deal with this situation, this is very unusual circumstances where you appeared to have 3 different names in 3 different doucments and the USCIS IO is confused on how to deal with this situation and requesting the evidence just to make sure that he is issuing GC to appropriate person.
I know in india it is possible to have these kind of mistakes, but unfortunately USCIS doesnt understand it. you have to have to good attorney to respond this RFE.

I came to know that my 485 wld bet rejected and I wld be receiving all my applications as my employer has sent wrong fee to lawyer...
yesterday when I asked my company people to send the copies of all those checks that they have sent to lawyer and I found the 485 check has $385 on it....actually I just asked them after going through couple of threads related to 485 rejections in murthy.com...and got this bloody news..
I cleary sent mails abt sending $395 to my lawyer and our company has sent 385 it seems...due to the excessive volume of apps received at that time my lawyer office hasn't really checked all those checks it seems...they clubbed those checks with the my application and sent to TSC...and my lawyer informed that i wld get rejection....
can't they understand how sensitive it is?..can't they put their full mind while writing checks?...this is just ridiculous...
i have become victim of someones mistake,,,,,
i'm not saying that it is intentional but can't they be responsible?...
now after all this has happened they r talking abt SORRY stuff,,who cares...
friends,,psl help me,,,waht shld I do now...did anyone has similar case status?

If the H1 - transfer gets denied, isn't there an option of filling a appeal? I guess, one has 15 days to get out of the country, but he or she ca file & appeal & stay in the country but cannot work...

Hello,
My 6 years on H1B is going to expire in Oct 10. I want to file for extension but the lawyer says that i can do it only after Mar 10 that is 6 months before h1b expires.
I have to visit my home country in May 10 and i wanted to go with my new h1b documents.
Can you please suggest if i can file now or is there really a timeframe before we file?
Sorry forgot to mention, I have approved I140.

Also, you can see, EB1+Eb2ROW has s always been in the 50-70K range every year

Check recent visa bulletin. Now a days, bringing spouse by Citizen and GC holders are of not much difference. Go to India and do the marriage, and come back and file I-130. December bulletin calling for August 2010 filers. Forget about H1B and F1.
